THE PROGRESS OF THE EXCURSIONS IS SUBJECT TO THE PROVISIONS OF THESE GENERAL CONDITIONS

I decline all responsibility for the consequences due to non-compliance with the general conditions of sale; without any reduction in the damages that I may present due to the prejudice suffered as a result of this non-compliance. In the event of a dispute or dispute, the French courts will have sole jurisdiction.

Booking conditions

It is best to book as early as possible, in view of the tourist influx and the limited number of places.

Reservations are free, accepted by phone, email or at our points of sale (website, holiday centres, ticket offices, etc.)

Reservations are confirmed only after verification of availability at points of sale as well as payment of the ticket or payment of 30% of deposit of the total price of the service. - Transport tickets are only issued against full payment.

Seats are not numbered or assigned.

The company accepts payment in cash, credit card, checks and holiday vouchers. Change is not given on holiday vouchers.

We ask pregnant women and people with any physical problem to report at the time of booking.

Any reservation implies for the customer, the commitment to respect the present general conditions of sale.

Cancellation conditions

From our customers:

If cancellation of reservation notified at least 72 hours before the date of the excursion, the deposit (or total payment) will be returned in full (no fees retained). Any cancellation notified within 72 hours before the date of the excursion results in the deduction of 30% of the total amount of the excursion.

Changes are free up to 24 hours before departure, postponements are subject to remaining availability. Any modification notified within 24 hours before the departure of the excursion results in the deduction of 30% of the total amount of the excursion.

In the event of a reduction in the number of passengers, this may lead to a questioning of the pricing conditions granted in the context of the initial reservation.

In the event of a change in the planned number of passengers, the absence of one or more people or the failure to accommodate additional passengers, does not constitute a reason for cancellation of the planned reservation attributable to the shipping company.

Passengers must present themselves for boarding 15 minutes before the scheduled departure time, no reimbursement can be demanded in the event of the passenger's delay.

From the CMPV:

If cancellation due to meteorological, technical or nautical conditions, passengers can be reimbursed in full without any fees retained, excluding any damages. Otherwise, the customer can postpone his excursion to another date subject to availability at the point of sale.

Schedules and routes

The times are defined by the CMPV company at Propriano Marina.

The shipping company CMPV reserves the right to modify circuits, activities and schedules or to cancel the services if the departure of the ship is hindered by an exceptional event, cause of force majeure, fortuitous or other (eg weather, damage).

The CMPV will do its best to notify passengers of any changes as soon as it becomes aware of them.

Only the Captain is authorized to judge the conditions of navigation and is likely to cancel a maritime service.

Boarding

Passengers must present themselves for boarding 15 minutes before the departure time.

Any passenger, even with a ticket, arriving outside this period will have no recourse against the company if he cannot board.

To access on board, all passengers must have a ticket. The ticket must be kept in good condition by the passenger throughout the duration of the trip.

Minors must be accompanied by their parents.

Access to the upper decks of ships is strictly prohibited for children under 12 years old.

The Captain is entitled to refuse access on board to any person whose behavior may endanger the safety of passengers or disturb the smooth running of the cruise (drunkenness, agitated behavior, etc.)

Dogs are accepted on board our ships, however, in order to guarantee the safety and comfort of passengers, we reserve the right to refuse certain dogs. We remind you that animals travel under the full responsibility of their owner, under the orders of the Captain on board and must be kept on a leash.

When embarking for the excursion, and disembarking, each passenger must comply with the instructions of the crew and respect the safety instructions.

Security

Boarding passengers undertake in all cases to comply with the ship's regulations, established by the CMPV and visible on board, as well as to comply with the crew's instructions.

For any excursion on CMPV ships, it is recommended: to wear flat shoes, to bring a jacket in case of cold weather, to wear sun protection.

Bathing authorized during stopovers is your responsibility.

During navigation, it is desired and advised to remain seated; if however you decide to move, it would be under your full responsibility.

CMPV ships are subject to European regulations relating to the transport of passengers. The ship has a navigation license, renewed after annual inspection, attesting to the ship's compliance with the technical standards relating to the safety of passenger ships (stability, buoyancy, solidity, fire prevention and extinction, lifesaving devices, etc.)

The crew has professional certificates such as a Command, Chief Engineer or Seamanship Certificate (Nautical Initiation Certificate). These certificates also imply the possession of: a first aid training certificate, a swimming certificate and the possession of a CRO certificate (Certificate Radio

Operator). On the other hand, each seafarer is required to undergo an annual physical fitness medical examination before a seafarer's doctor.

Special insurance covers all passengers. Passengers are however obliged to respect the safety instructions displayed on the ship with the on-board regulations.

The Maritime CMPV company reserves the right to cancel or modify a service for security reasons.

Financial conditions

The descriptions of the services presented on the site www.promenades-en-mer.org, on the brochures, and any other medium for the distribution of the CMPV specify, for each service, the services included in the price (indicated in Euros). The prices of the services are inclusive of all taxes (TTC). The website and any other dissemination medium published by the CMPV do not constitute a contractual document. The information is given for information only. Programs and rates may be subject to change.

The CMPV shipyard reserves the right to modify its prices at any time depending on the economic situation (fuel) or the modification of taxes (VAT, port and usage taxes, Eco-taxes in favor of protected natural sites) .

Liability and warranty

On transport related to excursions: It is governed by the laws of June 18, 1966, January 3, 1967 and December 23, 1986 as well as the related decrees.

The responsibility of the carrier could not be engaged in the event of modification of route, schedule or cancellation of departures due to force majeure, fortuitous or other.

The vessels of the CMPV are subject to yacht insurance.

The shipping company is not responsible for objects on board, damage to property and personal effects (jewellery, precious metals, personal papers and documents, sound or image reproduction devices, mobile phones, glasses, clothing, luggage hands…)

In the event of theft, loss or deterioration of these, no compensation, reimbursement or indemnity will be made.

Intellectual property

Any graphic or textual element presented on the site www.promenades-en-mer.org, brochures, flyers, posters or any other advertising medium of the CMPV remains the intellectual property of the CMPV. Is responsible for the content of these media, as director, Mr. Jean-Thomas Boghossian.

Once the ship has departed, no complaints will be accepted, neither regarding the applicable tariff nor regarding the route taken.

Pictures and illustrations

The CMPV makes its best efforts to provide photos and illustrations giving you an overview of the services selected.

Applicable right

The general conditions, and more generally the contract that you conclude with the CMPV are subject to French law.

Any dispute relating to their interpretation and/or execution is subject to the French courts.
